1. Introduction
AnimeList.moe respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
This policy outlines how to submit a DMCA takedown notice if you believe your copyrighted work has been infringed on our platform, and how users may submit a counter-notification if they believe content was removed in error.
2. Copyright Infringement Claims
If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted material has been posted on AnimeList.moe in a way that constitutes copyright infringement, please submit a DMCA takedown notice to our designated agent.
Content that may be subject to DMCA notices on our platform includes:
- User-uploaded images (avatars, banners, post attachments)
- User-generated reviews, posts, or discussion content
- Any other user-submitted content that infringes your copyright
3. DMCA Takedown Notice Requirements
To be effective under 17 U.S.C. § 512(c), a DMCA takedown notice must be a written communication that includes substantially the following:
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of Work: Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, and information reasonably sufficient to permit us to locate the material. Please provide the specific URL(s) where the infringing content is located.
- Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Counter-Notification Procedure
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, the Western District of Missouri), and that you will accept service of process from the person who provided the original notification or an agent of such person.
Timeline: If we receive a valid counter-notification, we will forward it to the original complainant. If the original complainant does not notify us within 10-14 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed content.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, AnimeList.moe has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.
We may also, at our sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

8. Good Faith & False Claims Warning
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages.
We reserve the right to ignore DMCA notices that do not substantially comply with the requirements of 17 U.S.C. § 512(c)(3), and we may seek to recover damages from any party that submits a false or fraudulent notice.
