These Terms of Service constitute a legally binding agreement between you and AnimeList.moe regarding your use of the Service. By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

By using this Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• You are not prohibited from using the Service under applicable laws
• You will comply with all applicable local, state, national, and international laws

If we discover or have reason to believe that you are under 18 years of age, we will immediately terminate your account and delete your data without notice.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Account Registration:

• You may register using email/password or through OAuth providers (Google, Discord)
• You may not use another user's account without permission
• Usernames must not impersonate others, contain slurs, or suggest official/staff status
• You are responsible for maintaining the security of your account credentials

Account Actions:

• We reserve the right to suspend accounts temporarily for policy violations
• We reserve the right to permanently ban accounts for severe or repeated violations
• Suspended or banned users may not create new accounts to circumvent restrictions
• Account termination decisions may be appealed through our appeal process

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, state, or local regulations, rules, or laws
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, flood, or overwhelm other users or the service
• To interfere with or circumvent the security features of the Service
• To use automated systems, bots, or scripts without explicit permission
• To scrape, data mine, or harvest user information
• To abuse our API or exceed reasonable rate limits
• To create multiple accounts to circumvent bans, suspensions, or restrictions
• To engage in any activity that could damage, disable, or impair the Service

Users may post reviews, comments, discussions, and other content. By posting content, you agree to follow our Community Guidelines. Your content must not:

• Contain hate speech, threats, or harassment
• Include personal information of other users without consent
• Violate copyright, trademark, or other intellectual property rights
• Contain spam, advertising, or unauthorized commercial content
• Include illegal content or content that violates applicable laws
• Contain CSAM (child sexual abuse material) of any kind, real or fictional
• Include revenge porn or non-consensual intimate imagery

NSFW Content:

• NSFW (Not Safe For Work) content is permitted but must be properly marked
• Users must use the NSFW toggle when posting adult content
• Profile images (avatars, banners) should not contain explicit content
• Failure to properly mark NSFW content may result in account action

Spoilers:

• Use spoiler tags for plot reveals, especially for currently airing shows
• Episode discussions should only contain spoilers up to that episode

The Service and its original content, features, and functionality are and will remain the exclusive property of AnimeList.moe and its licensors. The Service is protected by copyright, trademark, and other laws.

Anime and manga information, including titles, descriptions, images, and metadata, are sourced from public databases (MyAnimeList via Jikan API, TMDB, YouTube) and are used for informational purposes.

If you believe that content on our platform infringes your copyright, please see our DMCA Policy for information on how to submit a takedown notice.

By posting content on AnimeList.moe, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the Service.

This license allows us to:

• Display your content to other users
• Include your content in feeds, search results, and recommendations
• Store and cache your content for performance
• Format and adapt your content for different devices

You retain ownership of your content. This license terminates when you delete your content or account, except where your content has been shared, echoed, or otherwise distributed by other users.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

You retain ownership of your personal data, including your anime/manga lists, reviews, and preferences.

Your Data Rights:

• Export: You may export your data through your account settings
• Deletion: You may delete your account at any time, which permanently removes all your data
• No Retention: We do not retain your personal data after account deletion

Our Service integrates with and displays content from third-party services:

• Jikan API (MyAnimeList): Anime and manga metadata
• TMDB: High-quality images and artwork
• YouTube: Trailers and promotional videos
• Google/Discord: OAuth authentication

We are not responsible for the accuracy, completeness, or availability of third-party content. Third-party services are governed by their own terms of service and privacy policies.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Suspension vs. Ban:

• Suspension: Temporary restriction of account access (1 day to 6 months)
• Ban: Permanent termination of account and platform access

If you wish to terminate your account, you may do so through your account settings. Account deletion is immediate and permanent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ANIMELIST.MOE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Third-party content (anime/manga data from Jikan, TMDB, YouTube) is accurate or complete

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANIMELIST.MOE, ITS OPERATOR, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

LIABILITY CAP: Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service shall not exceed one hundred US dollars ($100.00) or the total amount you have paid us in the twelve (12) months preceding the claim, whichever is greater.

You agree to defend, indemnify, and hold harmless AnimeList.moe, its operator, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service
• Your use of the Service
• Your content or submissions
• Your violation of any rights of another party
• Your violation of any applicable laws
• Any claim that your content caused damage to a third party

Informal Resolution: Before filing any claim, you agree to first contact us at legal@animelist.moe to attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you and AnimeList.moe agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court.

Class Action Waiver: YOU AND ANIMELIST.MOE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions: You may bring claims in small claims court if your claims qualify. Either party may seek injunctive relief in court for intellectual property infringement.

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States of America, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Missouri, USA.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
